These Terms of Service (“Terms”) govern your access to and use of iCarded.com and all related products and services (collectively, the “Services”). By accessing our website or placing an order, you agree to be bound by these Terms in full.

If you do not agree, do not use our Services.

1. Binding Agreement

By placing an order, you confirm that:

  • You are at least the age of majority in your jurisdiction

  • You have the legal authority to enter into this agreement

  • You understand and accept that iCarded products are custom-made and final sale

We reserve the right to refuse service to any individual or entity at our sole discretion.

2. Custom Products & Customer Responsibility

All iCarded products are custom-made to order using customer-submitted content and selections.

You acknowledge and agree that:

  • You are solely responsible for all uploaded images, text, names, stats, and selections

  • You have reviewed all customization details before checkout

  • Once production begins, changes cannot be made

iCarded is not responsible for errors caused by customer-provided content, including spelling, image quality, layout choice, or design preference.

3. FINAL SALE – NO RETURNS OR CANCELLATIONS

ALL CUSTOM AND PERSONALIZED PRODUCTS ARE FINAL SALE.

Once an order enters production, it cannot be canceled, returned, exchanged, or refunded, except as expressly stated under the Manufacturer Quality Guarantee below.

This applies to:

  • Custom photos, names, stats, and text

  • Design templates, layouts, or color choices

  • Holographic, shattered-glass, or specialty finishes

  • Add-ons, upgrades, and limited editions

4. 14-Day Manufacturer Quality Guarantee (LIMITED)

iCarded provides a 14-day manufacturer quality guarantee strictly limited to verified production defects.

Eligible defects include ONLY:

  • Printing errors

  • Material flaws

  • Manufacturing defects

This guarantee DOES NOT cover:

  • Design preference or dissatisfaction

  • Customer-uploaded image quality

  • Color variation due to screen differences

  • Layout, font, or template choice

  • Optional upgrades or finishes

To submit a claim:

  • You must contact us within 14 days of delivery

  • You must provide your order number

  • You must provide clear photographic evidence

Approved claims will result in either a replacement OR a refund, at our sole discretion.

5. Non-Refundable Fees

The following are strictly non-refundable:

  • Shipping and handling

  • Rush processing

  • Customization or design fees

  • Optional upgrades

  • Gift cards

6. Unauthorized Returns

Items returned without prior written authorization will be rejected and not refunded.

7. Chargebacks & Payment Disputes

By placing an order, you agree to contact iCarded before initiating any chargeback or payment dispute.

Unauthorized chargebacks may result in:

  • Immediate account restriction

  • Order cancellation

  • Submission of evidence to payment processors

  • Permanent refusal of future service

8. Intellectual Property

All templates, designs, graphics, branding, and website content are the exclusive intellectual property of iCarded.

Unauthorized use, reproduction, or distribution is strictly prohibited.

You retain ownership of uploaded content but grant iCarded a limited, non-exclusive license to use it solely to fulfill your order.

9. Prohibited Content

You may not upload content that is:

  • Illegal, infringing, defamatory, or obscene

  • Violates third-party rights

  • Misrepresents identity or ownership

We reserve the right to cancel orders and refuse service for violations.

10. Limitation of Liability

To the maximum extent permitted by law, iCarded shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Loss of use, revenue, or data

  • Customer dissatisfaction unrelated to manufacturing defects

11. Indemnification

You agree to indemnify and hold harmless iCarded from any claims arising from:

  • Your submitted content

  • Your misuse of the Services

  • Your violation of these Terms

12. Governing Law & Venue

These Terms are governed exclusively by the laws of the State of California.
Any disputes shall be resolved in courts located in Los Angeles County, California.

13. Modifications

We reserve the right to update these Terms at any time. Continued use of the Services constitutes acceptance of any changes.

14. Disclaimer: Donations apply only to purchases completed through your organization’s unique referral link. Sales made outside of the referral link are not eligible for donation.

15. User-Submitted Design Disclaimer

By uploading, submitting, or using your own custom designs on iCarded.com, you represent and warrant that you own or have obtained all necessary rights, licenses, permissions, and authorizations to use, reproduce, distribute, and display the content you submit. You agree not to upload any material that infringes upon or violates any copyright, trademark, patent, publicity, privacy, or other intellectual property or proprietary rights of any third party.

You acknowledge and agree that you are solely responsible and liable for all content you upload and for any claims, damages, losses, liabilities, costs, or expenses arising from or related to your submitted designs, including claims of intellectual property infringement. iCarded.com does not review or verify ownership of user-submitted content and assumes no responsibility for uploaded materials. You agree to indemnify, defend, and hold harmless iCarded.com, its owners, employees, and affiliates from and against any such claims or liabilities.
